PWD's Accomodation

 As I was on the bus going home today from church, I noticed something that catches my attention. I was standing for about 20 minutes on a bus then I saw this sign "FOR DISABLED PERSON". 

I understand that all seats were occupied, but the fact that the reserved seat for PWD has been occupied too and was not offered to me by the person sitting on it and the conductor was just busy collecting fare is a disturbing event. I don't mind if I keep on standing until I reach my destination because I can carry myself well enough, but what about those PWD's who can't even stand on their own and needs attention? Were they being offered a seat or deprived of taking the bus because it's full and the "RESERVE" seat has been occupied?

To recognize PWD's aren't enough, we need to be accommodated according to the law. This law is the Accessibility Law or Batas Pambansa 344. This law requires public transport, like buses and jeepneys to reserve seats nearest the exit and/or entrance doors for persons with disabilities (PWD) for better access, safety, and comfort. It is a requirement by the law. I'm making this appeal for my fellow PWD's to access their rights and for the public to know and recognize these rights. Also to call the attention of the concerned agency to take action for this matter.


A Derogative Term

According to the United Nations enable "The term persons with disabilities is used to apply to all persons with disabilities including those who have long-term physical, mental, intellectual or sensory impairments which, in interaction with various attitudinal and environmental barriers, hinders their full and effective participation in society on an equal basis with others. However, this minimum list of persons who may claim protection under the Convention does not exhaust the categories of the disabilities which fall within it nor intend to undermine or stand in the way of wider definition of disabilities under national law (such as persons with short-term disabilities). It is also important to note that a person with disabilities may be regarded as a person with a disability in one society or setting, but not in another, depending on the role that the person is assumed to take in his or her community. The perception and reality of disability also depend on the technologies, assistance and services available, as well as on cultural considerations. In most parts of the world there are deep and persistent negative stereotypes and prejudices against persons with certain conditions and differences. These attitudes themselves also shape who is considered to be a person with a disability in each society as well as have contributed to a negative image of persons with disabilities. The language used to refer to persons with disabilities has played a significant role in the persistence of negative stereotypes. Clearly, terms such as “crippled” or “mentally retarded” are derogative. Other terms such as “wheelchair-bound” or “disabled persons” emphasize the disability before the person. The drafters of this Convention were clear that disability should be seen as the result of the interaction between a person and his or her environment. Disability is not something that resides in the individual as the result of some impairment. This convention recognizes that disability is an evolving concept and that legislation may adapt to reflect positive changes within society."

Marimar N.Remollo : I feel sorry for you Sir and the conductor should have the initiative to tell those persons who were seating at the disable seat to transfer or give way for you.Ohh Im sorry but not only the conductor should have the initiative also the person who were seating at the disabled seat should already have the initiative to offer you the seat.There should be a solution for that. The company/management should take it seriously like they should have strictly tell their conductors that the seats for disabled is reserved for disabled persons only not unless there's no disabled passenger.

Putting oneself to another is not that easy especially to those disabled person.They are worthy that they are physically complete but their presence is mentally absent.It must be an insult to those person who occupied the seats reserved for PWD's in this situation.For no one does'nt care or even notice for them to seat.This happening is the reason to feedback who they are than the patience they value their concern .

  3. The conductor should give the attention to the PWD's who in need because of thier physical liability, not just to ignore them. And one of the solution is that the company of the transportation should give reserved seats for the PWD's but not only for the disabled person(senior citizen,pregnant or carrying babies).For those people, like you sir should give the importance of what you have especially in riding whatever transportation because as a human we have heart to feel of what others feel to be secure.We also give or show our time to them in order to feel that they are important cause they're part of our society.

  4. As for my opinion, I can say that we can rarely meet people nowadays who cares about the sake of others especially those who have disabilities. The conductor should have considered your situation and accommodated you. The passenger who were sitting on the disabled person's reserved seats should have offered you the seat that was really meant for people who have disabilities. The management should have taken seriously the law that the government had implemented. They should have trained their employees the correct approach in this kind of situation. And for the other people who did not care about the said situation, I pray to God that you will all open your hearts to learn to care and love to people who were born with disabilities and would kindly offer the seat that are really meant for them.

  5. All of us have the right to choose freely. Example: If you have P20.00(twenty pesos) on your pocket and someone or lets say your brother/sister will ask for that money, are you going to give them? THE FINAL DECISION IS YOURS!If you think that someone deserve to receive something why wont you give. You are fortunate because you have the resources. It is a matter of helping. The feeling that you have help someone is unpayable and unexplainable. We have the Law for PWD (Person with Disabilities) but do you know a simple way how to follow that LAW? Just simply respect someone and everything will be put into right.

  6. mariel gomez..In that situation before the bus will ride the driver and conductor must have seminar because we need to recognize the PWD passenger.For the reason that they cannot cater their self in the certain situation.And the vacant seat it is reserved for PWD but they never follow the rule of the management.It was an insult to the person who occupied the seat reserved for PWD's without looking to the situation.So,it is not satisfaction of knowing that to a greatest or lesser degree what did served because the important of us are the values,respect and care to the person.

  7. janet sabroso...In that situation i can suggest to the driver and the conductor that they have to give concern to those PWD's passenger.It is their big responsibility to give opportunity to PWD's to sit down in the vacant seat .I recommend also to those people who is none PWD's that we have to give some value to them.We have to care of them like we care to ourselves.

    to the PWD's person.It is not good of what passengers did.They should have an initiative to offer in it.We should accomodate and give concern with them .It is not easy to be with there situation.We should not ignore or neglect .We give attention and care,like we did to other person.

    It is an LTFRB requirement to require buses, jeepneys and other public transport vehicles to have a PWD seats reserved for the PWD (Persons with disability). As my experience riding a public bus, I always make sure that senior citizens, pregnant women and PWDs will be seated comfortably, as much as I want to seat in front or near doors, I just make sure that the PWD seats must be vacate. In your experience, it was really a heartbreaking moment when the conductor didn’t even bother to offer you a seat, they were trained to entertain PWDs and to offer you a seat. We can’t blame the persons seating in the PWD seats as they are maybe not aware that a PWD entered and nowhere to sit. For me sir, if this incident will happen again, we can always tell the bus management to remind the drivers, conductors and inspectors to always prioritize the persons with disabilities. As a citizen, we should be considerate to offer our seat and assistance especially to the PWDs, pregnant women and elderly.

    The management should have take the full responsibility in that matter. The conductor must do his/her duty in order for the PWDs to be accommodated.   12. we must value to every person that has disabilities. because it is not easy to traveled and riding in a bus that you are disabled. we must prioritize to person with disabilities.As I observed every bus has a sticker for PWDs which inform everyone that PWDs are the first priority to sit in the bus. not only for the PWDs but also for the Pregnant Woman and the senior citizen. we keep in mind that they have the right as the first priority for everyone to sit in the bus, jeepney and other transportation. As I observed that every bus via Dumaguete-Bayawan or vise versa they are posted sticker for PWDs, pregnant Woman and the senior citizen that emphasize that they are the priority to sit in the bus even in jeep and other transportation. we must give their right as disabled person and we must keep in mind that they have more rights than us. It is not easy for them traveling in a long distance while standing.And I can suggest that we must not selfish for them and we let them to accommodate and prioritize them and offer them the set that I am accommodating. if it is hard for us not PWDs how about for the person with disabilities. so we must value their rights as person with disabilities. jonalen estolonio

  14. Some people are having disabilities that they encountered in their life. On that matter we should never look down them because they are part of the society, we should love them and respect since we are blessed that we don't have the same thing with them.
    As part of the community , everyone should be united.Our country is a democratic country and some people authorized to be the leader to manage the process in engaging the people that involve in this country. To be the leader as the chosen person of the people,leader should look forward for the people that belongs to his/her own managing.
    They say that Filipinos are one of the most hospitable people in Asia. Filipino hospitality reflects the Filipinos warmth and personal touch, a culture that is really more other-oriented that self-oriented. Everyone should in their mind that in our community we should also love our countrymen even if having disability or not.
    The values that are essential for us to have is the commitment, this value goes beyond concern for oneself and welfare of others. We should take some care of people having disabilities because many things and happening that they are going to suffer like in transportation. Buses and jeepneys should have a specific place where PWD will be going to set.
    Therefore, we must treat them respectfully as we treated ourselves so they may not feel rejected and they have value.

We should never think only on our own safety, we must think other first mostly to them that needs our full attention, for them to become comfortable in travelling. On the other hand, buses and jeepneys should have a specific place where PWD will be going to seat. The governance should act on this problem in order for everyone to respect the rules that targeting to care people having disabilities. The people that have higher position should organize the transportation for PWD.

    I feel so bad about this kind of situation,each transportation services must required to have a more separate seat for "Person with Disability".I understand that the conductor cannot accommodate all his/her passengers especially if the bus is overloaded.But what they have to prior most are them,for its not easy standing when he/she is impaired.Not just one or two are disabled,but there's more,so if possible the government must have a plan regarding to this issue.Based on my observations not all PWDs are equal,some are gifted with such special ability,while others do not.

    Most physically-abled commuters occupy those spaces provided for PWD's because they think that it would be okay to sit in there and people most often tend to ignore the sign that space is for PWD's.All citizens must educate their selves enough about this particular case to ensure to PWD the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedom.Safety,Comfort and better access to all things should be given to humanity especially to PWD.

  19. For my opinion sir,courtesy on public transportation has become a bit lacking,and also many people now don't mind other people's need as long as they get comfortable. They can understand what they see in front if their eyes but still they ignore it for their own good. It sounds harsh but todays generation most people could never understand the idea that disabled person should need to prioritize.
    I sometimes sit in for disabled person seats if there is empty, but I figure I'm morally obliged to get up if somebody who really needs come along, and I do. For the situation you experience sir,I'm hoping that people will get up and give up their seats to someone even slightly older than them especially disabled once.

      In my opinion on that given article which you recently experience,the company of that certain bus didn't any strict rules and guidelines for their tenants to follow and to implement on their fields,by which the conductor act on that day. They should be respobsible enough for those passengers who have disabilities. And I am prettt aware of the consequences that the conductor might suffer in violating the rule, if there is a person who will complain to their company. But on the other side of my mind says that,what if who sit on the seat of the person has disability also,not physically but mentally or emotional or other forms of disabilities? If not,so, there should be what we call initiative term on giving priority especially for SC and PWDs.

  21. the notion that i got from reading the speech was "injustice".There were so many things that were made intended for PWD yet it wasn't equally catered to them . Bitter!BUt its the fact of todays era. it seems like people were blind with their own selfishness and nonchalant to others. this could be a bitter fact for todays young people.

    youths OF TODAY'S are more bold which i concluded as a great chalenge for the adult's ,like teachers and parents . All in all ,everythingchanges.

  22. The Notion that i got from reading the speech was injustice. There were so many things that were made intended for PWD yet it wasn't equally catered to them . Bitter!But it's the is the fact of today's era . It seems like people were blind with their own selfishness and nonchalant to others.
    Youths of today are more bold which i concluded as a great challenge for the adults ,like teachers and parent. All in all,everything change. the norms that we had up to the present were truly different.Including the values and characters we treasured slowly cast-off as years ascends which i found to be very threatening and thus, badly needs a cure action.

There is a law obliging buses to reserve seats for PWDs but seats for them are occupied by physically normal passengers.This is despite a sign at the top of the seat.In case of emergenies, these people cannot get out of vehicles as quickly as able-bodied men and women. The closer they are to exists,the easier it will be for them to save themselves.Imagine, you supposed to take the seat but stood for almost an hour or longer.This is a call for the attention of the bus companies for non compliance of the law and impose penalties to conductors.

Only few who will prioritize, help and assist to the people with disabilities. They should be fair and practice what is right. Show respect through manners.

    In this new generation,people nowadays are very creative in making inventions like bus.but what was bus for? Was that only for for perfect people? What about people with disabilities? I strongly agree that there should be a space for people with disabilities in the bus.God created us equally,meaning we have equal rights.     Some people now a days sir are like that,especially now in our generation. In fact they are more capable of managing their selves to stand for a couple of hour or until they reach their destination and offer their seat to the passenger who really need it the most. Not just for PWD's but also for those senior citizens and pregnant women. We don't have to enumerate or tell them what to do. Remember that we are Filipino and we have the culture to respect one another especially older ones. Although, we are not talking about culture here but the satisfaction of others not ourselves.

    For us, it is important to follow the law of government, to contribute the betterment of our society. We need to help raise up and harmonize humanity. It is important to educate the leaders of the bus companies such as drivers, conductors and inspector's the public transport institution, so that they will serve better their passenger especially for the person with disabilities. And also, it requires that the public transport should reserve seats for the disabled person for protection and safeness. As a public minded person it is a prime importance to protect the dignity and liberty of a person with disabilities. Everyone are equal so, respect all human being.

    Only have good way on how to love the disabilities person,if they vacant chair in the bus we must seated the disabilities person.Do not shouted the disabilities person cannot seated in the bus because you are made by god.There law ,there way on how to achieve your own decisions.Granted by PWD's are known us way on how to help the disability person.NOT all people have good manner and right conduct, be yourself on who are,although we make to learn on how to use of it.

    Nowadays people know what is right and what is wrong but they did not mined that. Others are just look at those PWD's standing rather than offered a seats for the PWD's but also for pregnat woman, senior citizens and person carrying babies. They just think their selves first before anyone else. Every individual has the rights, that is why they should be treated well even though we are physically complete or not because we live as one. Love, respect and acceptance is what all we need.

  32. For the PWD’s, the public must observe proper accommodation to this kind of persons, to those who don’t know what is PWD’s, the meaning of PWD’s is Person With Disabilities. PWD’s such as blind, deaf, mute, mongoloid and all kind which the composition of the body is developed incomplete. This kind of person are persons who needs the special attention from the public such as transportation services, public services such as schools, malls, and etc. PWD’s for me, are the weak part of the society that’s why they need the support from those capability is able to help and support their needs. On the other hand PWD’s are the strongest persons because their strength is God. That’s why helping PWD’s are the way to show what kind of country we are or what kind of individual we are.

  36. As I have observed on people of today, gentle one is rare to find especially when you're in a long trip. Most has the crab mentality attitude that always wants to be "lamang" than others. In this case, I strongly disagree that PWD are only be referred to persons who have lack of parts on his/her body. In my own opinion, it also must be referred to those people who only thought for their own good. Why? Because being selfish is a mental illness. According to the Wikipedia as I researched for the meaning of disability, it states that "Disability is an impairment that may be cognitive, development, intellectual, mental, physical, sensory, or some combination of these." And so if this people sitting on the seat reserve for PWDs are mentally and emotionally healthy as their body, they would be the one who takes the initiative to offer the seat to sir Neil upon he stepped on the deck of the bus without waiting for the conductor to ask them to. They are physically capable but mentally disabled. They can't think what's best for them and also for the others.

    "Let me begin this remarks of mine by saying " Do not base the way you treat a person with a disability on the person's disability"

    We, individuals will remain an individual regardless of the disability that we have. We should value the PWD's as we did it to ourselves,respect and dignify them becausing like we, they also have their feelings of getting hurt.

    In the case of yours sir, it is already in the initiative of the people who indeed are sitting on the PWD's sit to give you the way because the fact is that, it is designed for the person with disability.

    As far as I am concern, conductors and even drivers of buses are being intitled to have an orientation regarding on dealing passengers like your situation sir, before being on the field.

    To the conductors and operators of buses, you should not only after and think for the fair that you will be collecting because you are also there to GIVE COMFORT AND SATISFACTION TO YOUR PASSENGERS"

    PWDs are those people who needs attention. We must prioritize them in all aspects because we are capable enough to manage ourselves. But sad to say, some people become blind and deaf especially younger ones now a days. Although they know the right thing to do but they choose to ignore them.

    As I read this, I felt pity for seeing a person ignored or don't offer a seat to the disabled person . Like for example crossing the road , eventhough this is not required but we need to help them. We are lucky and fortunate than them but we should be fair to them. And every buses or public transportation should have a reservation chair for them. and Inside the mall as well , because the other mall don't have employee to assist every disabled person. Especially in private department store , PWD's need to be serve first and always have discounted because they don't have income, but it depends on every person with disabilities.

The government must strictly implement this law and must inform those companies on transportation to tell their conductors to reserve seats for disabled person but not only for disabled person but also for those senior citizen and pregnant women. The conductors must also inform those passengers that the seats in front near to the door is for disable and pregnant women. For those person who sits on reserve chairs they must have initiative to stand up and offer the seats for those deserving one.

    Based on the above statements, my understanding is we should respect and recognize the rights and privileges of those persons with disabilities. The purpose of the BP 344 is to make them comfortable and this law should be given more attention by public utility vehicles. They should conduct seminars and training for their employees, how they value the rights of those persons with disabilities.
